[VIEW COMPLAINT] Title IX complaint filed against TCBOE for boys baseball having “superior facilities” over girls softball

FAYETTEVILLE, Ala. – In December 2017, a detailed Title IX complaint was filed to the Department of Education Office for Civil Rights against Fayetteville High School (FHS) and the Talladega County Board of Education (TCBOE).

The complaint was filed by Christopher Liner and lists his daughter as the person discriminated against. The complaint claims FHS softball facilities are incomparable to the facilities that are used by male athletes and requests an investigation be launched by the Office for Civil Rights against TCBOE and FHS.

On the FHS campus, the boys baseball facility is fully equipped with a concession stand, restrooms, dugouts with roofs, metal bleachers, and sidewalks. The girls field, however, is not equipped with such conveniences.

The complaint states improvement proposals for facilities have been presented to the FHS administration and the TCBOE Director of Operations Kelvin Cunnningham, but the requests have been denied. Cunningham denied that claim when asked by SylacaugaNews.com.

“I’m not aware of anything that has been taken to the administration, but I have not received anything directly in regards to this,” said Cunningham.

Cunningham is aware, however, of the filed complaint, and has been contacted by the Office for Civil Rights. He told SylacaugaNews.com the TCBOE is complying with the Office for Civil Rights and willing to provide any information requested. “We received a copy of the complaint that was filed and OCR asked for certain information,” Cunningham explained. “We will provide that information to them and we are working with them.”

Cunningham explained once the Office for Civil Rights reviews the information and it may send a representative to FHS to investigate.

SylacaugaNews.com reached out to FHS Director of Athletics John Limbaugh and Superintendent Suzanne Lacey. Neither responded to requests.
